ORDER

The petitioner pursuant to the earlier order dated 04.03.2025 has filed the additional affidavit. On perusal of the said affidavit, it is seen that the petitioner has been in occupation of lands in Survey No. 12/1c, P.Viralipatti Village, Nilakottai Taluk, Dindigul District for the past 30 years and he has been cultivating the said lands along with his brother Mayilraj.

2. The grievance of the petitioner is that without even conducting a physical inspection, the lands under cultivation by the writ petitioner have been assigned to one Jothiyammal. The petitioner, has therefore, sought for cancellation of the said assignment and has given a representation in that regard on 23.1.2024. The petitioner seeks expeditious disposal of the said representation. 2/5

3. Considering the limited scope of the prayer sought for by the writ petitioner, the writ petition is taken up for final disposal at the time of admission, with the consent of the counsel appearing on either side.

4. Without going into the merits of the entitlement of the petitioner to seek cancellation of the assignment, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's request for cancellation of the assignment in favour of Jothiyammal after hearing the petitioner as well as the said assignee Jothiammal, in accordance with law, on merits. The said exercise shall be carried out within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, the writ petition is disposed of. No costs.
