ORDER
This Criminal Original Petition is filed seeking for a direction to the police not to harass in respect to the complaint allegedly given by the second respondent.
2. It is submitted by the learned counsel for the petitioner that the second respondent has purchased some property from petitioners 1 and 2 and according to second respondent, he paid Rs.2 Lakhs more than the sale consideration to the petitioners. However, the petitioners are not returning the said amount. Thereby the second respondent has filed a representation before the first respondent police. The first respondent stated to have issued notice to the petitioners to appear and without appearing even before the first respondent, the petitioners stated to have approached this Court.
3. It is also submitted by the learned counsel for the petitioners that the second respondent has earlier moved similar representation before the Chozhapuram Police Station, Thanjavur District, where the petitioner appeared and after enquiry, the said petition was closed. 2/4
4. The learned Government Advocate (Crl.side) submits that the first respondent is not aware of the earlier complaint given by the second respondent before the Chozhapuram and the enquiry was conducted and closed.
5. Considering the same, the petitioner is hereby directed to appear before the concerned police and furnish the papers, if any, in respect of the proceedings before the Chozhapuram police station given by the second respondent in respect of the dispute pending between the petitioner and the second respondent. On such submission of papers, the first respondent police are directed to complete the enquiry and close the same, within two weeks from the date of application.
