ORDER : The Court Made the following order :- The petitioner is arrayed as accused No.1, who was arrested and remanded to judicial custody on 23.06.2016 for the alleged offence punishable under Sections 394 and 397 of I.P.C., in Crime No.289 of 2016, on the file of the respondent police and hence, seeks bail.

2. The case of the prosecution is that the petitioner and others hired an Indica Car of the de-facto complainant and while the car was proceeding towards Kodaikanal at 10.30 a.m., the accused attacked the de-facto complainant with knife and took the car and cellphone. On complaint, case has been registered against the petitioner for the aforesaid offences.

3. The case of the petitioner is that the petitioner is innocent and the dispute arose between A4 and the de-facto complainant and the petitioner got down from the car and the petitioner is a coolie worker working in the estate and he was not in the place of occurrence and only based on the confession of A4, the petitioner has been implicated in this case and he is in custody from 23.06.2016 .

4. The learned Government Advocate (Crl.side) submitted that the petitioner and other accused persons took the car of the defacto complainant on hire and attacked the de-facto complainant and https://hcservices.ecourts.gov.in/hcservices/

took the car and cellphone and the investigation is pending.

5. Considering the serious nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed.
