ORDER

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate, Rajapalayam to expedite the trial in C.C.No.251 of 2017 on the file of the learned Judicial Magistrate, Rajapalayam.

2. According to the petitioner, the petitioner is the de facto complainant in this case. Based on his complaint, FIR has been registered in Crime No.130 of 2015 and now the case is pending in C.C.No.251 of 2017 on the file of the learned Judicial Magistrate, Rajapalayam. Though the case is pertaining to the year 2015, till date no trial has been commenced. Therefore, the petitioner filed this petition.

The learned Additional Public Prosecutor appearing for the respondent would submit that already in this case A-2 died and now the case is posted for production of death certificate of A-2 and also posted for examination of witnesses and issued summons to L.W.1 to L.W.3 and they will cooperate for speedy trial and they will produce the witnesses as directed by the Trial Court. 2/5

Since the prayer of the petitioner is to dispose of the case within the stipulated time, this Court considering the pendency of the case from the year 2015 onwards and now the case is posted for trial, it is appropriate to direct the Trial Court to complete the trial proceedings without giving any long adjournment. Accordingly, the learned Judicial Magistrate, Rajapalayam is directed to expedite the trial proceedings and dispose of the case as early as possible without giving any long adjournment beyond 15 days.

5. With the above said directions, this Criminal Original Petition stands allowed.
