ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to issue the passport to the writ petitioner based upon his application dated 29.12.2025 and considering the petitioner's explanation dated 09.02.2026.

The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.13 of 2021 on the file of the second respondent wherein the petitioner has been charged under various provisions of various NDPS Act. A charge sheet has also been laid and taken on file in C.C.No.78 of 2021, on the learned Additional District and Sessions Judge/Presiding Officer, Special Court for E.C. and NDPS Act. 3.Considering the fact that the petitioner is facing a trial under the NDPS Act, this Court is not inclined to consider the request of the petitioner for issuance of the passport. It is for the petitioner to approach the first respondent depending upon the outcome of C.C.No.78 of 2021. 2/4

4. With the above said observations, this writ petition stands disposed of. No costs.
