: Respondents (Crime No.426/2013) Prayer : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure praying to direct the Respondent No.1 to withdraw the case in Crime No.426 of 2013 under sections 279 and 337 of IPC on the file of Respondent No.3, dated 02.09.2013 and entrust the same to the Respondent No.2 for investigation of the case by a Competent Officer and file a final report before the Jurisdictional Magistrate within the time period stipulated by this Court.

This Criminal Original Petition has been filed to direct the 1st respondent to withdraw the case in Crime No.426 of 2013 on the file of the 3rd respondent and entrust the same to the 2nd respondent for investigation of the case by a Competent Officer and file a final report before the Jurisdictional Magistrate within a period stipulated by this court.

2.Today, O.K.Sivaji Ganesan, Sub Inspector of Police, Othakadai Police Station, Madurai District and Mr.V.Jayamanikam, Sub Inspector of Police, Traffic Investigation Wing II, Madurai City, are present. On instructions, the learned Government Advocate (Criminal side) submitted that the investigation in Crime No.426 of 2013, has been completed and the charge sheet has also been filed before the Judicial Magistrate, Melur, on 10.04.2017 and the charge sheet was returned for certain compliance and now, the returns have been complied with and the charge sheet has been re-presented before the Judicial Magistrate, Melur, on 18.04.2017 and the same has not taken on file.

3.Recording the same, this petition is closed with a direction to the Judicial Magistrate, Melur, to pass appropriate orders in the charge sheet in Othakadai Police Station Crime No.426 of 2013.
