Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing respondents to grant permission and police protection to conduct the programme namely "Kida Muttu" on 10.04.2022 morning from 7.00 a.m., to evening 05.00 p.m., in Arulmighu Sri Manthaiyamman Temple "Panguni Pongal" festival on 08.04.2022 to 10.04.2022 in the petitioner's Village (V.Kalpulichanpatti Village), Usilampatti Taluk, Madurai District on the basis of the petitioner's representation dated 04.03.2022.

ORDER
[Made by R.VIJAYAKUMAR, J.] The present writ petition has been filed seeking a writ of mandamus directing the respondents to grant permission and police protection to conduct the programme namely "Kida Muttu" on 10.04.2022, on the basis of his representation dated 04.03.2022. 1/3
Since the respondents have not considered the representation dated 04.03.2022, the present petition has been filed.
2. The matter was adjourned seeking instructions from the respondents with regard to grant of permission.
3. Today, learned counsel for the petitioner produced an order passed by the second respondent herein on 18.01.2022 granting permission to a similar function imposing various conditions. According to the learned counsel for the petitioner, the permission was granted on 18.01.2022 for a village in the same taluk by the second respondent herein.
4. Learned Single Judge of this Court vide order dated 11.01.2022, has granted permission to the similar event imposing various conditions which the Government has accepted and permitted the said villagers to proceed with the said event.
5. Considering the fact that the present second respondent has already granted permission to another nearby village within the same taluk and accepted the orders of this Court dated 11.01.2022 made in W.P.(MD) No. 528 of 2022, we do not find any reason to reject the request of the petitioner. The writ petition needs to be allowed subject to the conditions imposed by learned Single Judge in W.P.(MD) No. 528 of 2022 dated 11.01.2022 apart from the conditions imposed by the second respondent herein in its order dated 18.01.2022 qua mamarathupatti village.
6. W.P.(MD) No. 5424 of 2022 stands allowed in above terms. No costs.
