Heard both sides.

2.The petitioner is a resident of Batrakalipuram Village in Bodinaikanur Taluk. His father had earlier filed W.P(MD)No.24911 of 2018 seeking removal of encroachments in the PWD channel running through Kodangipatti Village. The said writ petition was disposed of on 17.11.2022. Pursuant to the direction given by this Court, it is stated that action was taken and the encroachments were removed. However, the fifth respondent is not 2/5

sure regarding the current position. He therefore states that the request will be placed before the Tahsildar, Bodinayakanur to conduct survey and find out if there are encroachments in Survey Nos.802/4 and 805/1. If the survey indicates that there are encroachments, it is assured that action will be taken to remove the same. Be that as it may, we issue a continuing mandamus to the fifth respondent to ensure that the petition mentioned PWD channel is kept free from any kind of encroachment for all times to come. 3.This Writ Petition is disposed of accordingly.
