PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF CERTIORARIFIED MANDAMUS to call for the records relating to the impugned order passed by the 2nd respondent vide his proceedings in Letter No.GE3/55315/2025 dated 27.01.2026 quash the same as illegal and 2/7

consequently direct the respondents No.1 and 2 to promote the petitioner as Assistant Executive Engineer.

The petitioner is working as an Assistant Engineer in the Agricultural Department. The petitioner, with a grievance that though the official respondents have called for certain particulars from his juniors for the promotion panel for the post of Assistant Executive Engineer, by a proceedings, dated 27.01.2026, he has not been called for any details, has filed this writ petition. 2.The learned counsel appearing for the petitioner by referring to the communication of the Chief Engineer to the Superintending Engineers and the Executive Engineers dated 27.01.2026 submits that non-inclusion of the petitioner's name in the proceedings, dated 27.01.2026 would affect his promotional 3/7

opportunity, when his juniors names were found place in the list. 3.Mr.G.V.Vairam Santhosh, learned Additional Government Pleader, who takes notice for the respondents 1 & 2 submits that the order impugned in this writ petition is only a proforma sent by the Chief Engineer, Chennai, calling upon certain particulars from the concerned Assistant Engineers and the Junior Engineers, who are eligible to be promoted as Assistant Executive Engineers. According to him, it is not the promotion panel for the post of Assistant Executive Engineer and in fact, the panel would be prepared only after getting details from the concerned Engineers. Moreover, after preparation of the promotion panel, it would be notified and opportunity would be provided to the employees to raise their objections, if any, to the Panel. 4.This Court considered the rival submissions made and also perused the materials placed on record.

5.The petitioner, under the apprehension that his juniors would be promoted without preparing a panel has filed this writ petition. Now, the Department has clarified that it is only a communication, calling upon certain particulars from the employees and they would prepare the promotion panel by providing sufficient opportunity to the concerned persons.

6.In view of the submissions made by the learned Additional Government Pleader, this writ petition is dismissed, as the apprehension of this petitioner is unwarranted. No costs. Consequently, connected Miscellaneous petitions are closed. 24.02.2026 NCC: Yes/No Index:Yes/No Internet:Yes vrn 5/7
