ORDER

Seeking to transfer the investigation in Crime No.264 of 2025 on the file of the 3rd respondent to the 2nd respondent, this criminal original petition is filed.

The learned counsel for the petitioner submitted that despite the complaint being lodged by the petitioner as early as on 17.07.2024, the respondent police had remained idle without even issuing a CSR. Hence, the petitioner had filed a writ petition in W.P.Crl(MD)No.1957 of 2025, in which this Court has directed the respondent police to take necessary action, following which F.I.R in Crime No.264 of 2025 was registered for the offences under Sections 406, 420 and 506(1) IPC on 04.11.2025 on the file of the 3rd respondent as against Madasamy and others. However, there is no progress in the investigation to such an 2/6

extent that the accused persons have not even availed anticipatory bail. Hence, this petition.

3. The learned Government Advocate (Crl. Side) submitted that the issue pertains to job racketing. The petitioner is not cooperating with the enquiry. The accused persons are regularly appearing for enquiry and have denied the allegations against them. The petitioner has not produced a copy of the agreement alleged to have been entered into between him and the accused persons.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. The plight of the petitioner is that even after giving sufficient materials, there is no progress in the investigation. However, the learned Government Advocate claims that the petitioner had not submitted necessary material to substantiate the dispute as a job racketing dispute. Unless the petitioner cooperates, there cannot be any 3/6

progress. In this regard, the 3rd respondent is directed to conclude the investigation as expeditiously as possible within a period of four (4) weeks from the date of receipt of copy of this order and further directed to apprise the progress of the investigation every Friday to the 1st respondent. The petitioner is directed to furnish all the necessary materials to the 3rd respondent Police. The 1st respondent police is directed to monitor the investigation conducted by the 3rd respondent.

6. With the above directions, this Criminal Original Petition is disposed of.
