O R D E R
This petition has been filed to direct the respondents 1 and 2 herein to provide adequate police protection for life and limb of the petitioner and her daughter's family from the third respondent and his men.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
3.The case of the petitioner is that the petitioner's daughter fell in love with the third respondent and eloped with him. Therefore, the petitioner preferred a complaint before the respondent Police against the third respondent. In such https://hcservices.ecourts.gov.in/hcservices/
circumstances, on 11.09.2016 the third respondent along with others murdered the petitioner's son. Due to which, the case has been registered in Crime No.591 of 2016 on 11.09.2018 for offences under Sections 147, 148, 302, 506 (ii) of IPC. Thereafter, since there is a life threat to the petitioner and her family members from the third respondent, she has made a representation dated 07.03.2018 to the second respondent. Since no action was taken, the present criminal Original Petition is filed before this Court. 4.According to the learned Additional Public Prosecutor that on the basis of the complaint given by the petitioner, the respondent Police has already provided police protection to the petitioner.
5.According to the petitioner still there is a life threat to the petitioner. In view of the aforesaid submission, if there is a life threat to the petitioner's life, she can make a fresh application to the authority concerned.
6.In fine, this Criminal Original Petition is disposed of, directing the petitioner to make a fresh application to the second respondent Police, if any threat to her life and her family members and on filing of such application, the first respondent / Superintendant of Police, Dindigul District, Dindigul, shall consider the same and pass appropriate orders on merits and in accordance with law, after providing opportunity to the parties concerned.
