ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondent to expedite the proceedings in Na.Ka.No.

10030/2023/A4, dated 29.07.2024, pending on the file of the respondent within a stipulated time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submitted that the subject property originally belonged to one Sembulingam, the petitioner's grandfather, who died intestate and without any legal heirs. After his demise, Periyakaruppan, the brother of the petitioner's grandfather, was in possession and enjoyment of the property, and the patta in respect of the said property stood in his name. Upon his demise, the property devolved upon the petitioner's father, who was the sole legal heir of the said Periyakaruppan. After the demise of the petitioner's father, the petitioner and his siblings have been in possession and enjoyment of the said property. Seeking transfer of patta, the petitioner submitted an application dated 27.06.2023. Thereafter, on 29.07.2024, the respondent sent a communication directing the petitioner to produce all the relevant documents for effecting transfer of patta. Since no action has been taken thereafter, the petitioner has filed the present Writ Petition.

The learned Additional Government Pleader appearing for the respondent submitted that, if the petitioner submits all the required documents, the petitioner's representation will be considered and appropriate orders will be passed on merits and in accordance with law within the time frame to be fixed by this Court.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the petitioner to submit all relevant documents before the respondent. Upon the petitioner producing all the relevant documents, the respondent shall consider the petitioner's representation and pass appropriate orders on merits and in accordance with law, after providing a reasonable opportunity of hearing to all the necessary parties concerned, within a period of sixteen (16) weeks thereafter. There shall be no order as to costs.
