Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 1st and 2nd respondents to consider granting promotion to the petitioner, who is a senior as he was already appointed as Grade -III, Librarian on 04.08.1997 under the 2nd respondent whereas the 3rd respondent joined as a junior on 01.10.1997 under the District Seniority as Grade -III Librarian, whereas he is now manning a senior rank of Grade -I, Inspector of Library Posts based upon the representation of the petitioner dated 22.02.2018 by giving opportunity of hearing to the 3rd respondent.

ORDER
The prayer in this writ petition is to direct the 1st and 2nd respondents for granting promotion to the petitioner by considering his representation dated 22.02.2018 after affording opportunity of hearing to the 3rd respondent.
2.Heard the learned Counsel for the petitioner and the learned Special Government Pleader appearing for the official respondents. https://hcservices.ecourts.gov.in/hcservices/
By Consent, this writ petition is taken up for final disposal at the stage of admission itself.
3.Pointing out that the third respondent, being a junior to the petitioner, was granted promotion upto the post of Grade I Librarian / Inspector of Libraries, whereas the petitioner still continues to be as Librarian Grade-II, he submitted a representation, requesting for promotion with retrospective effect. Since such a request has not been acted upon by the official respondents so far, the petitioner has approached this Court.
4.The learned Special Government Pleader appearing for the official respondents, submitted that the representation of the petitioner would be considered on merits.
5.Under these circumstances, this Court, without going into the merits of the case, directs the 1st and 2nd respondents to consider the petitioner's representation dated 22.02.2018 on merits and in accordance with law and pass necessary orders, after affording opportunity of hearing to the petitioner as well the 3rd respondent, within a period of eight weeks from the date of receipt of a copy of this order.
6.With the above direction, the writ petition is disposed of. No costs.
