ORDER
This petition has been filed seeking to quash the FIR in Crime No. 93 of 2007 on the file of the 1st respondent police. 2.The learned counsel for the petitioner would submit that on the basis of the complaint given by the second respondent a case in Crime No.93 of 2007 has been registered by the first respondent for the offence under Section 6(3) and 14(1) of the TNSC (PDCS) Order 1988 r/w 7(1) a(ii) of EC Act, 1955, against the petitioner. By raising various grounds, the petitioner filed this petition seeking quashment of the above said FIR. 3.Earlier, it was submitted that the final report was filed before the concerned Court, closing the above said FIR as undetected. Hence, a report was called for from the trial Court. Report was also received stating that so far no final report has been filed.
On that ground the Inspector of Police, who is the Investigating Officer in this case was directed to be present before this Court along with CD file.
Judicial Magistrate No.VI, Trichy. He would further submit that they are going to file the final report now only.
4.Let the final report be presented before the concerned Court. So that the second respondent/defacto complainant can workout their remedy through appropriate proceedings.
5.In view of the above said development, now the matter has become infructuous.
6.Accordingly, this criminal original petition is dismissed as infructuous. Consequently, connected miscellaneous petition is closed. 05.06.2023 NCC :
