JUDGMENT

This First Appeal is filed to set aside the Judgment and Decree dated 10.08.2022 made in O.S.No.141 of 2020 on the file of the Principal District Court, Karur.

2. Heard the learned Counsel appearing for the appellant and the learned Counsel appearing for the respondent and perused the materials available on record.

3. This case was referred to Mediation on 08.12.2023 and accordingly, a settlement agreement entered into on the same day itself before the Tamil Nadu Mediation and Conciliation Centre, Madurai Bench of Madras High Court, Madurai between the appellant and the respondent. In view of the same, this Court is inclined to dispose of this appeal in terms of the settlement agreement between the parties. The Mediation report and the terms of the settlement agreement are hereby recorded and the same will form part and parcel of the Judgment and decree of this First Appeal. 2/5

4. The respondent herein is permitted to withdraw the amount of Rs.2,00,000/- (Rupees Two Lakhs only) which has been deposited before the Principal District Court, Karur.

5. Hence, this First Appeal is disposed of in terms of the settlement agreement. There shall be no order as to costs. Consequently, connected Civil Miscellaneous Petition is closed.
