ORDER

Seeking to direct the respondent police to comply with the order dated 25.09.2026 in Crl.M.P.No.22142 of 2025 in C.S.R.No.341 of 1/5

2025 by the Judicial Magistrate Court No.V, Trichy, this criminal original petition is filed.

The learned counsel for the petitioner submitted that the petitioner had filed Crl.M.P.No.22142 of 2025 before the Judicial Magistrate Court No.V, Trichy, in which the learned Magistrate had passed an order on 25.09.2025 directing to retransfer the amount from column No.4 to column No.2 of respective accounts, from the amount stated in column No.3, which was fraudulently transferred. However, the same was not complied by the respondent police. Hence this petition.

The learned Government Advocate (Crl.Side) submitted that the respondent police had taken necessary steps to transfer money from the various defreezed bank accounts to the various victims on the direction of the various Courts other than this Court and from the Courts of other States. As on the date of the order passed by the learned Judicial Magistrate, only an amount of Rs.50,000/- was available in the 2/5

said account and the said amount was duly transferred to the petitioner's account.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

It is seen from the nature of records placed before me that the entire fraud involved in the case is an online money fraud involving huge amount of money where umpteen number of victims were defrauded by the offenders. In this regard, though the petitioner had lost an amount of Rs.33 lakhs, the respondent police was able to transfer only Rs.50,000/- to his account due to the non-availability of the necessary funds in the freezed account. The petitioner is directed to take necessary steps by making suitable application before the learned Judicial Magistrate No.V, Trichy and also lodging a fresh complaint to the respondent police in this regard for recovery of further money to which he is entitled. However, the respondent police is directed to produce the copy of the transaction slip by which they have already transferred Rs.50,000/- to the petitioner by serving the same on him in accordance with law.

6. With the above directions, this Criminal Original Petition stands disposed of.
