ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking direction to call for the records in unnumbered Cr.M.P in C.F No. 1026/2023 in C.C No. 203 of 2018 dated 13.02.2023 docket order passed by the Judicial Magistrate No.1, Dindigul and to set aside the same and consequently to direct the Judicial Magistrate no.1, Dindigul to number the warrant Recall petition.

2. The learned counsel for the petitioner would submit that the petitioners are admitted in Neuro One hospital.

3. Considering the submission made by the learned counsel appearing for the petitioner, the petitioner is directed to appear through Video Conference Call before the concerned trial Court on 17.03.2023. After appearance of the petitoner through video conference call, if the trial Court finds that the petitioners are admitted in hospital and taking treatment, may process the petition that was presented by these petitioners and dispose of the same on its own merits in accordance with law.

4. With the above said direction, this Criminal Original Petition stands disposed of. Consequently, the connected Miscellaneous Petition is closed.
