Writ Petition is filed under article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling records pertaining to the refusal slip No.RFL/Manapparai/16/2026 issued by the 2nd respondent herein and quash it as illegal and subsequently direct the 2nd respondent to register the sale deed in petitioner's name. ORDER

This writ petition is filed challenging the impugned refusal check slip.

2.By the impugned order, the sale deed presented by the petitioner was refused to be registered. Obviously, when the petitioner traces title to a parent document and now by virtue of section 34C of the Act, unless the original parent document is produced, the authority will only pass a refusal check slip. It is also second reason that is mentioned that the entire property seems to have been sold by the third parties already. 3.In respect thereof, the learned counsel submit that the authorities have mistakenly construed the survey numbers and want to convince the authorities on the merits of the matter. In respect thereto, it will be open for the petitioner to convince the authorities on merits. But however, unless the original deeds produced now by virtue of Section 34C of the Act, the impugned refusal slip cannot be interfered with. 4.In view thereof, giving liberty to the petitioner to present the document along with the original deed, this repetition stands disposed of. No costs.
