ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first and second respondents to pay the difference in compensation for the lands in Survey Nos.109/2A2, 108/3C2, 100/9B, 101/5C, 101/6, 101/7, 108/1B6, 109/5A2, 109/3 and 109/5AIF, situated at Kallikudi (North) Village, Srirangam Taluk, Trichy District, at the rate of Rs.1880/- per sq.mtr. as per guideline value and further to conduct rehabilitation and resettlement for the land as per Section 31 of Act 30/2013 by fixing the compensation as per Section 3G(7) a to d of National Highways Act, 1956 read with Sections 26 to 30 of Central Act 30/2013 and the same has to paid to the petitioners by passing orders, by considering the petitioners' representation dated 02.02.2026, within the time fixed by this Court.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel for the petitioners submits that the petitioners' lands in Survey Nos.109/2A2, 108/3C2, 100/9B, 101/5C, 101/6, 101/7, 108/1B6, 109/5A2, 109/3 and 109/5AIF, situated at Kallikudi (North) Village, Srirangam Taluk, Trichy District, have been acquired by the respondents. However, compensation has not been fixed in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Aggrieved by the same, the petitioners made a representation dated 02.02.2026 seeking enhancement of compensation, which has not been considered till date. Hence, the present Writ Petition has been filed seeking a direction to the respondents 1 and 2 to consider the petitioners' representation and grant enhanced compensation in accordance with law.
4. The learned Government Advocate appearing for the respondents 1 to 3 would submit that the first respondent would pass appropriate orders on the representation of the petitioner on merits and in accordance with law within a time frame to be fixed by this Court.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioners' representation 02.02.2026, on merits and pass appropriate orders in accordance with law after providing reasonable opportunity of hearing to the petitioner and any other persons, who may be affected by such decision, within a period of sixteen weeks from the date of receipt of a copy of this order.
