ORDER
The present petition has been filed seeking to quash the F.I.R. in Crime No.11 of 2020 dated 13.02.2020.
2. The petitioner is a defaulter after borrowing loan from the Canara Bank, Karaikudi, and his properties have been brought to auction under the SARFAESI Act. When the same were taken under the custody of the respondent Bank, the petitioner is alleged to have broken open and entered into the property and removed the machineries from the rice mill. 3.The allegations in the F.I.R. reflect the commission of cognizable offences. In such an event, no grounds have been made out to interfere in the investigation process. The request of the petitioner to consider the pendency of the SARFEASI proceedings as a defence, cannot be considered at this stage. There are no merits in the Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition is also closed. 02.03.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 2/4
