ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent. 2.The petitioner herein seeks anticipatory bail for the offences under Sections 8(c), 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985 of IPC, in Crime No.51 of 2020. 3.According to the prosecution, based on specific information they intercepted three persons, who were carrying bags and moving suspiciously. On seeing the police party, while two other persons ran away from the scene of occurrence, one was caught and on interrogation, he revealed his name as Chinnasamy and other two persons, who ran away from the scene of crime were Sekar and Soundarapandian. Further, the said Chinnasamy in his confession statement, has stated that he and this petitioner and other two https://hcservices.ecourts.gov.in/hcservices/
accused persons, who fleded from the scene of occurrence, purchased Ganja and transported in the public transport bus. While, the three accused got down at Sikkatchiamman Kovil bus stop, the petitioner herein has proceeded in the same bus to Kombai. Therefore, after seizing 4 Kgs of Ganja, this petitioner was also arrayed as one of the accused in the said crime number along with other three accused. 4.The learned Government Advocate (Crl. side) would submit that this petitioner is the son of the first accused and the third accused is the son-in-law of the first accused and as a family, they were indulged in illicit transport of Ganja and this petitioner having one previous case in Crime No.355 of 2019, on the file of the Kombai Police Station.
5.In the light of the above fact, this Court is of the view that granting anticipatory bail to this petitioner is not conducive. Hence, this petition is dismissed.
