sq.ft., situated in Daily Market in No.2, New Street, in Bodinayakanur, for the period from 2022-2025 and quash the same and its further action declaring the third respondent as highest bidder as illegal, as it contravenes to the resolution dated 18.08.2022 in Na.Ka.No. 3272/2020/A2, passed by the Municipal Council, which authorized to allot the shops and vacant site by way auction cum tender and in consequence to direct the second respondent to conduct a fresh auction to allot 40 shops and the vacate site measuring 10.969 sq.ft., situated in Daily Market, in No.2, New Street, Bodinayakanur Town by following the due procedures under the Tamil Nadu Transparency in Tenders Act and Rules.

ORDER

The present writ petition has been filed seeking to quash the tender notification dated 20.09.2022 issued by the second respondent Municipality for the collection of rent from 40 shops for the period 2022-2025. The petitioner also seeks a declaration declaring the third respondent as the highest bidder to be illegal. 2/4

2.According to the learned counsel appearing for the second respondent, the period covered under the tender notification has already expired in the year 2025 itself and, therefore, nothing survives to be adjudicated.
