ORDER

It is an application seeking a direction to the respondents not to harass the petitioners under the guise of enquiry in respect of a complaint given by one Lakshmanan. 2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) for the respondents. 3.The learned counsel for the petitioners would submit that the petitioners are tenants under one Lakshmanan/landlord and since the landlord tried to evict them unlawfully, they filed a civil suit in O.S.No.319 of 2016 and obtained interim injunction restraining the landlord from interfering with their peaceful possession and enjoyment of the property. He would further submit that only after receipt of summons in the suit, the defacto complainant preferred a complaint against the petitioners and based on the same, the respondents are threatened them to vacate the property.

4.The learned Government Advocate (Criminal Side) would submit that the petitioners have been called for enquiry only on the basis of the complaint given by the landlord and not to decide the civil rights of the parties in the Police Station and that they did not cause any harassment to the petitioners. However, he gave an undertaking that the respondents Police will not interfere with the civil dispute pending between the petitioners/tenants and the landlord by name Lakshmanan. 5.Recording the above undertaking given by the learned Government Advocate, this Criminal Original Petition is closed.
