Usilampatti Town, Usilampatti SubD, Madurai South RD, on the basis of the settlement deed, vide doc.No.919/2005, dated 28.04.2005 and the settlement deed vide doc.No.2929/2025 dated 30.06.2025 on the file of the Sub Registrar, Usilampatti.

The present writ petition is filed for a certiorarified mandamus to quash the impugned order and to direct the third respondent to survey the land and thereafter, issue patta.
2. The learned Government Advocate for the respondents submits that there is area mismatch between the land and the documents. Totally, the land is an extent of 596 sq.ft. Earlier, the land to an extent of 496 sq.ft was registered and only 100 sq.ft is available to register. However, the petitioner is seeking survey of the land to an extent of 102 sq.ft. When there is no land available, the petitioner is not entitled to the land and also to survey the said land.

3. However, the learned counsel for the petitioner submits that if an enquiry is conducted, whatever is available to the petitioner would be registered and that would suffice for the petitioner.
4. In view of the above submissions, the impugned order is quashed and the third respondent/Tahsildar is directed to conduct an enquiry. The petitioner shall submit all relevant records. Thereafter, the third respondent shall pass orders in accordance with law. While passing orders, the above observation shall be taken into account.
