PRAYER: Criminal Original petition filed under Section 482 of Code of Criminal Procedure, directing the second respondent herein not to harass the petitioner by compelling the petitioner to undergo the demands of the de-facto complainant M.O.Perumal and not to conduct Katta Panchayat on Civil dispute.

O R D E R

This Criminal Original Petition has been filed to direct the second respondent not to harass the petitioner based on the complaint given by one M.O.Perumal.

2.The learned counsel for the petitioner submitted that already two civil suits are pending before the lower Court and one FIR is pending against the said M.O.Perumal before the Usilampatti Town Police Station. He further submitted that at the instigation of the complainant M.O.Perumal, the second respondent is frequently calling upon the petitioner under the guise of enquiry and harassing the petitioner.

3.The learned Government Advocate (Crl. Side) appearing for the respondents submitted that the said M.O.Perumal has lodged a complaint on 21.11.2017 and the petitioner was also appeared for an enquiry. He further submitted that the presence of the https://hcservices.ecourts.gov.in/hcservices/

petitioner is necessary for further enquiry and the second respondent is not harassing the petitioner.

4.Considering the aforesaid submission, the second respondent is directed to enquire the matter and if the enquiry reveals any cognizable offence, it is for him to register a case and proceed further in accordance with law. Further the second respondent is directed not to harass the petitioner at the time of enquiry. 5.With the aforesaid direction, the Criminal Original Petition is disposed of.
