Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to settle a sum of Rs.18,650/- towards the payment of Post Retirement Benefits Scheme amount, together with interest at the rate of 6% p.a. payable to the petitioner from the date of his retirement i.e. 31.05.2018 and all other attendant benefits to him within the stipulated period.

*********** By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 2.The learned Counsel for the petitioner would submit that the petitioner was working as Foreman and retired from service on 31.05.2018. Prior to the Pension Scheme, there was a Scheme called Post Retirement Benefits Scheme [PRBS]. As per Clause 9(3) of the 12
(3) Settlement, the said Scheme was stopped and the amount recovered from the employees were agreed to be refunded at the time of their retirement. However, the amount of Rs.18,650/-, so recovered under the scheme from the salary of the petitioner was not refunded to the petitioner during his retirement. Thus, he made a representation in this regard on 12.10.2020 to the respondents. Since, the same is pending consideration, the petitioner has come up with the present writ petition.

W.P.[MD]No.6766 of 2021 3.Learned Counsel for the petitioner would submit that this Court may issue a direction to the respondents to consider the representation of the petitioner dated 12.10.2020. 4.In view of the above, this Court directs the respondents to consider the representation of the petitioner dated 12.10.2020, within a period of twelve [12] weeks from the date of receipt of a copy of this order.
5.Accordingly, this Writ Petition is disposed of. However, there shall be no order as to costs.
