Respondents P RAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the Impugned order in C.No.L1/7540/2020 on the file of the respondent No.2 and quash the same as illegal and consequently for a direction, directing the respondents to reconduct the 400 Meters Physical Efficiency test for the petitioner on an alternative date and allow the petitioner for the next level of selection process in the Recruitment to the post of Sub-Inspector of Police (Taluk, Armed Reserve (Men and Women/ Transgender) and Tamil Nadu Special Police Men 2019 within the time period stipulated by this Court.

O R D E R

This Writ Petition has been filed challenging the rejection order made in C.No.L1/7540/2020 dated 26.02.2021 by the second respondent rejecting the petitioner's request for re-conduct of 400 meters running.

2. In view of the various pronouncements of the Division Bench of this Court observing that the High Court cannot be a forum to order for retest, this Court is not inclined to entertain the prayer sought for in this writ petition. However, if the petitioner is of the view that the original test was not properly conducted, it https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.6665 of 2021 is always open to the petitioner to cross-check the same by making an appropriate application under the Right To Information Act [RTI] seeking for video recording of the test conducted and on verification of such recording, if the petitioner is of the view that he has qualified the physical tests, it is open to the petitioner to redress his grievances in a manner known to law.

3. With the above observations, the Writ Petition stands closed. No costs. Consequently, connected W.M.P.(MD) No.5147 of 2021 is closed.
