The Management v. General Secretary
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 08.03.2023
CORAM
THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN and W.M.P.(MD)No.4613 of 2023 The Management, Tamil Nadu State Transport Corporation (Tirunelveli) Limited, Tirunelveli Division - II, Vannarpettai, Tirunelveli District - 3.
... Petitioner Vs.
General Secretary, Tamil Nadu State Transport Corporation, Employees Welfare Union, Tirunelveli.
... Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, calling for the records relating to the impugned order passed by the Labour Court, Tirunelveli dated 28.11.2016 passed in I.D.No.52 of 2016.
For Petitioner : Mr.R.Rajamohan 1/4
ORDER
Heard the learned counsel for the writ petitioner. 2.The management challenges the impugned award passed by the Labour Court. The learned standing counsel took me through all the averments set out in the affidavit filed in support of the writ petition. He points out the delinquent employee had caused fatal accident leading to the death of two persons. Even though the punishment imposed on him was rather lenient, the Labour Court interfered with the same.
3.Even though the contentions advanced by the learned standing counsel are perversive, I am not inclined to interfere for the simple reason that the impugned award was passed as early as on 28.11.2016. No convincing reason has been given by the management for explaining the delay in mounting the challenge. Hence, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
