O R D E R

This petition has been filed seeking a direction to the learned Judicial Magistrate No.I, Tuticorin to dispose of C.C.No.233 of 2015 within a time limit to be fixed by this Court. 2.The case is registered under Sections 294(b) and 323 IPC. According to the learned counsel for the petitioner, there is a compromise between the defacto complainant and the accused person, but the Court was not able to accept the compromise in view of the specific bar under Section 320(ii) Cr.P.C.

3.The learned Government Advocate appearing for the respondent would submit that already 8 witnesses have been examined and that the trial almost completed.

4. Entertaining quash petition at the stage, when the matter is part-heard, would not be fair, but, considering the alleged old age and sickness of the petitioner, a direction for speedy disposal may be given.

5.Under such circumstances, the learned Judicial Magistrate No.I, Tuticorin, is directed to dispose of C.C.No.233 of 2015 within a period of one month from the date of receipt of a copy of this order.
