PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, to direct the respondents to allow the petitioner's husband namely Durairaj (CP 6389) S/o.Ariyanayagam to undergo his remaining period of sentence at the Central Prison, Palayamkottai by considering the petitioner's representation dated 04.02.2026.

O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] This writ petition has been filed for a direction directing the respondents to transfer the petitioner's husband namely Durairaj (CP 6389) S/o.Ariyanayagam from Central Prison, Madurai to Central Prison, Palayamkottai.

2. The learned Additional Public Prosecutor appearing for the respondents, on instructions, would submit that the petitioner did not submit any representation

to the Director General of Prison, Chennai seeking transfer of her husband. Further, the petitioner has failed to implead the Director General of Prison, Chennai as a party to this writ petition, since who is the competent authority to consider the representation submitted by the petitioner seeking transfer of prison.

3. On perusal of the records revealed that the petitioner submitted a representation, to the Director General of Prison, Chennai, however, failed to file any proof to that extent.

4. In view of the above, the first respondent is directed to forward the representation of the petitioner dated 04.02.026 to the Director General of Prison, Chennai for disposal. On receipt of the same, the Director General of Prison, Chennai is directed to dispose the representation submitted by the petitioner seeking transfer of prison from Central Prison, Madurai to Central Prison, Tirunelveli, within a period of four weeks from the date of receipt of a copy of this order.
