This Criminal Original Petition has been filed to direct the 2nd Respondent to file the final report in Crime No.180/2024, dated 28.06.2024.
2.When the matter is taken up for hearing the learned Government Advocate (Crl.Side) appearing for the respondents would submit that after the completion of investigation, a negative final report has been filed as mistake of fact, to that effect they also filed a report before the Judicial Magistrate, Usilampatti and the same is pending. The petitioner has also served with RCS notice. Therefore, nothing survives for further adjudication.
3.The learned counsel for the petitioner in reply would submit that so far the petitioner has not received any notice in respect of closure of investigation, therefore, liberty may be granted to the petitioner to challenge the final report.
4.Since the prayer of the petitioner is to file final report and the same was already filed, it is for the petitioner to challenge the same in 2/4
the manner known to law.
5.In view of the same, preserving the liberty of the petitioner to challenge the final report in the manner known to law, this petition is closed.
