Respondents/Complainants Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to direct the first respondent to transfer the investigation in Crime No.345 of 2017 pending before the second respondent to some other investigation officer under the monitor of the first respondent.

ORDER

This Criminal Original petition is filed for issuing a direction to the first respondent to transfer the investigation in Crime No.345 of 2017 pending before the second respondent to some other investigation officer under the monitor of the first respondent.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The petitioner states that a complaint was lodged by him as against the proposed accused and the same was registered in Crime No.345 of 2017, dated 19.06.2017 for the offences under Section 420 https://hcservices.ecourts.gov.in/hcservices/

of I.P.C. In the complaint, some serious allegations were made by the petitioner against some individuals stating that they produced fake Visa from the Immigration Department from Nguyen Van Minh. Though the case was registered in the month of June, 2017, it is stated that there was no further progress and Charge Sheet is yet to be filed.

4. Though the petitioner has not made any serious allegations against the second respondent/investigation agency, the apprehension of the petitioner appears to be with regard to the serious nature of crime and technical informations which the investigation officer is required for proceeding with further investigation.

5. Considering the nature of grievance expressed by the learned counsel for the petitioner before this Court, this Court is inclined to pass the following direction:- " The second respondent is directed to expedite the investigation and to file final report in Crime No.345 of 2017 within a period of two months from the date of receipt of a copy of this order. The first respondent is directed to monitor the investigation and to prevent any such crime by the proposed accused and his associates."

6. With the above direction, the Criminal Original petition is disposed of.
