ORDER

This Criminal Original Petition has been filed to direct the 3rd Respondent not to harass the petitioner and his family members under the guise of enquiry by considering his representation dated 18.02.2026.

2. When the matter has taken up for hearing, the learned Government Advocate (Crl.Side) submitted that already 3 criminal cases are pending against the petitioner. Due to the advent of the elections, the respondent police is swiftly taking action to maintain the law and order problem in the locality by giving alerts to the various trouble mongers, and there is nothing to panic about in this exercise.

3. Heard the learned counsels on either side and carefully perused the materials available on record.

4. It is the considered view of this Court that at the time of 2/4

election, law and order will be duly maintained. Considering the fact that the petitioner has got a criminal antecedent, directing him to maintain peace till the conclusion of the election, this criminal original petition is disposed of.

5. However, it is made clear that the respondent police should not require the petitioner to appear before them unnecessarily except otherwise for issuance of summon/notice under Section 62 Crl.P.C.,/ 64 BNSS, 2023, specifying the date, time, and purpose of enquiry. Oral or informal summons are prohibited.

6. With the above direction, this Criminal Original Petition is disposed of.
