ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioner's representation dated on 16.07.2025 with regard to cancellation of Patta No.321 and issue Patta in the name of the petitioner, on the basis of his possession in respect of property in S.No.66/9B to an extent of 0-03.50 Hectares respectively, situated at Kondasamuthiram Village, Thiruvidaimaruthur Taluk, Thanjavur District, within the period that may be stipulated by this Court.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. Since no adverse orders are going to be passed against the respondents 4 and 5, notice to the respondents 4 and 5 is hereby dispensed with.
4. The learned counsel appearing for the petitioner would submit that the petitioner is in peaceful possession and enjoyment of the subject property. However, Patta No.321 relating to the said property stands in the name of the respondents 4 and 5. Therefore, the petitioner submitted a representation dated 16.07.2025 to the respondents 1 to 3 seeking to cancel Patta No.321 and to issue patta in respect of the subject property in his favour. Since no action has been taken on the petitioner's representation, the present Writ Petition has been filed.
5. The learned Special Government Pleader appearing for the respondents 1 to 3 would submit that the petitioner's representation will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.
6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 16.07.2025, and pass appropriate orders on merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, the respondents 4 and 5 and
any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
