ORDER : The Court Made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 16.11.2015 for the alleged offences punishable under Sections 149, 302 and 3(2)(v) (POA) of Scheduled Castes and Scheduled Tribes Act, in Crime No.150 of 2015 on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that the petitioner and other accused attacked the deceased, who was working in the petrol bunk and caused death and on the complaint given by the defacto complainant, who is the brother of the deceased, the present case has been registered. 3.The learned counsel for the petitioner submitted that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the investigation is completed and charge sheet also filed and the petitioner is in judicial custody from 16.11.2015 and hence, he prays for granting bail to the petitioner.

4.The learned Government Advocate (Crl.side) submitted that the investigation is completed and the charge sheet is filed before the learned Judicial Magistrate, Nilakottai.
5.Considering the facts and circumstances of the case and also considering the fact the charge sheet has already been filed, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Nilakottai, Dindigul District and on further condition that the petitioner shall appear before the concerned Magistrate daily at 10.30 a.m., until further orders. sd/- 27/01/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
