O R D E R

This Criminal Original Petition has been filed seeking direction to the second respondent to register the case based on the complaint given by the petitioner dated 01.11.2017 and consequently direct the first respondent to supervise the investigation. 2.The proposed accused interfere with the petitioner's property and trying to encroach the said property. Therefore, the petitioner has made a complaint before the respondent police against the proposed accused.

3.The learned Additional Public Prosecutor submitted that an enquiry was conducted. The proceedings in Na.Ka.No.7880/2017, is pending before the Revenue Divisional Officer for granting patta. Therefore, the parties concerned gave under takes that they will abide by the decision of the order passed by the Revenue Divisional Officer, Melur.

4.The learned counsel for the petitioner requested this Court to grant liberty to the petitioner to approach before the concerned Civil Court or before the Revenue Divisional Officer Melur.

5. This Criminal Original Petition is dismissed, giving liberty to the petitioner to workout his remedy which is available under the law.
