Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 406 & 420 of I.P.C., in Crime No.Not known of 2017, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner, who was working as a Special Officer in Peravoorani Panchayat Union, had misappropriated the funds of the Panchayat, without obtaining proper permission from the authorities.

3.The learned counsel appearing for the petitioner submitted that the petitioner has been working in a dignified position and he never indulged in such illegal acts as alleged in the complainant. It is only at the instigation of some enimical persons the above complaint has been foisted against the petitioner in order to tarnish the image of the petitioner in the department. 4.The learned Government Advocate (Criminal Side) submitted that investigation is not completed.

5.The submissions made by the learned counsel on either side are considered. It alleged that during the time of occurrence, the petitioner along with the the Secretary of the various Panchayat cheated a sum of Rs.84,10,445/- which belongs to the Government. Now the case was registered as against this petitioner as well as the Secretary of the said panchayat. According to the prosecution, https://hcservices.ecourts.gov.in/hcservices/

so far the cheated amount was not recovered. The investigation is not completed. Hence, the custodial interrogation is very much necessary.
