PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Cr.No.03 of 2025 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 61(2) and 318(4) of BNS, in Crime No.03 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant, along with A-1, approached the petitioner seeking a sum of Rs.15,00,000/- to develop his business, for which the defacto complainant was willing to execute a mortgage deed in favour of the petitioner. It is alleged that the petitioner and A-1 cheated the defacto complainant by obtaining a power of attorney and issuing two cheques for Rs.15,00,000/-. When the defacto complainant presented the cheques, 2/5

they were returned for insufficient funds. When he demanded payment, he was threatened with dire consequences. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the offences committed by the accused persons are serious in nature.

5. This Court had already granted interim anticipatory bail to the petitioner, directing him to appear before the respondent police and cooperate with the investigation. However, the petitioner has not complied with the said condition. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed and the interim order already granted is hereby vacated. (S S Y J) 25.11.2025 jbr To
