This criminal original petition has been filed seeking transfer of investigation.
2.When the matter was taken up for hearing, the learned 1/3
Additional Public Prosecutor submitted that final report had already been filed for closing the case as mistake of fact. The Court below shall issue RCS notice to the petitioner so that the petitioner can file his protest petition. If the petitioner files such a protest petition, the same will be disposed of on merits and in accordance with law within a period of four weeks thereafter. Even if the police report is accepted by the Court below, the petitioner is always having the liberty of filing a private complaint against the accused. This is not a case in which transfer of investigation is going to yield any result.
3.With this liberty to the petitioner and with the aforesaid observation, this criminal original petition is disposed of.
