Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 5.

2. The petitioner alleges that the petition mentioned property is a common land and that it has been encroached upon by the sixth respondent. In the typed set of papers, there is not even a scrap of material to indicate that the land has been earmarked for public purpose or allotted for general purpose. It appears to be a private dispute between the writ petitioner and the sixth respondent. Hence, instituting writ proceedings is clearly misconceived. Hence, the Writ Petition stands dismissed. However, the dismissal of this writ petition will not come in the way of the writ petitioner from enforcing his rights in the manner known to law. Likewise, he is at liberty to file a fresh writ petition if sufficient materials are placed for invoking the writ jurisdiction of this Court. No costs.
