Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the second respondent herein namely, the Thasildhar, Pudukottai, to conduct an enquiry in-person and submit a report as per the direction given by the first respondent in his urgent Memorandum, dated 17.12.2020, and further to direct the third respondent to take necessary actions to provide police protection to maintain peaceful situation for construction of Temple superstructure in Survey No.521, situated at No.19 Mullur Village, Karaiyapatty Pasuvoyel, Pudukkottai T.K., Pudukkottai District, within the time frame fixed by this Court. 1/4

ORDER

This Writ Petition has been filed for issuance of Writ of Mandamus, directing the second respondent to make an enquiry, based on the direction given by the first respondent through Memorandum, dated 17.12.2020 and to grant Police protection in order to maintain peace at the time of construction of the Temple.

2. When the matter was taken up for hearing today, Mr.A.Pitchai, SubInspector of Police, Thirugokarnam Police Station, Pudukkottai District, was present before this Court. He stated that materials were purchased for construction of the Temple and that this Temple belonged to persons belonging to a particular community. He further stated that the matter was referred to the Revenue and the entire process has come to a standstill. He also stated that if the Revenue requires any Police protection, the same will be given by the respondent Police.

3. Taking into consideration the facts and circumstances of the case and the statement made by Mr.A.Pitchai, Sub-Inspector of Police, Thirugokarnam Police Station, Pudukkottai District, who was present before this Court, there shall be a direction to the second respondent to deal with the situation and to ensure that no law and order problem is created and as and when the Police protection is required and sought for, protection will be given to ensure the smooth progress in the construction of the Temple.
