O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to conclude the appeal proceedings in Na.Ka.No.3091085/2025/A3 with respect to the patta relating to S.No.189/7A, measuring a total extent of 171⁄2 Ares, situated at Nambampatti Village, Viralimalai Taluk, Pudukkottai District, within such time as may be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the third and fourth respondents, as no adverse orders are proposed to be passed against them.

3. The grievance of the petitioner is that the subject property belongs to the three branches of the petitioner's family. Originally, the petitioner's father, late Nallusamy, and his paternal uncle, Adaikagounder, were in possession and enjoyment of the property. However, without the Page No. 2 of 5

knowledge of the petitioner, the son of the said Adaikagounder, namely Thangarasu, along with the wife of the third respondent, namely Ramani Jayalakshmi, executed a Sale Deed in favour of the fourth respondent. Thereafter, mutation was effected and sub-division was also made.

4. Therefore, the petitioner filed an appeal before the first and second respondents on 07.06.2025, which was taken on file in Na.Ka.No. 3091085/2025/A3. Though the petitioner appeared for enquiry along with all relevant documents, no order has been passed till date. Hence, the petitioner has been constrained to file the present Writ Petition.

5. The learned Additional Government Pleader appearing for the first and second respondents, on instructions, would submit that appropriate orders would be passed on the petitioner's appeal by the first respondent within a period of sixteen weeks.

6. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to conclude the enquiry on the petitioner's appeal and pass appropriate orders on its merits and in accordance with Page No. 3 of 5

law within a period of sixteen (16) weeks from the date of receipt of a copy of this order. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the third and fourth respondents and any other interested parties who may be affected by such decision, before passing any order.
