ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 21(1)(a) (b) of Mines and Mineral (Development) Regulations Act r/w Section 379 of I.P.C, in Crime No.320 of 2017, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 11.11.2017, the petitioner illegally transported river sand through vehicle, without valid licence. When the respondent police questioned the same, the petitioner abused the respondent police. Hence, a case has been registered against the petitioner for the above said offences. 3.The learned counsel for the petitioner submitted that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution.

4. The learned Government Advocate (Crl.side) appearing for the State submits that the petitioner was not arrayed as accused in the above said crime number. Hence, the question of granting anticipatory bail to the petitioner does not arise. https://hcservices.ecourts.gov.in/hcservices/

5.Considering the facts and circumstances of the case and considering the said submission made by the learned Government Advocate (Crl.Side), the question of granting anticipatory bail to the petitioner does not arise.
