Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for the records in connection with the impugned proceeding of the third respondent dated 24.02.2019 and consequently quash the same as illegal arbitrary and not binding on the petitioner and consequently, direct the respondents to issue a fresh notification and the selection process for Professors in the Department of Civil Engineering, National Institute of Technology, Trichy in accordance with the Recruitment Rules of NIT's dated 29.05.2017. ORDER
This petitioner has come up with this Writ Petition to quash the impugned proceedings of the third respondent, dated 24.02.2019 and for consequential reliefs.
2. The petitioner questioned the notification for appointment as Professor (Level 14A, VII CPC equivalent to AGP 10500, VI CPC) in various Departments of NIT, Thiruchirappalli, on the ground that the notification specifying desirable qualifications / experience / achievements to the extent that the candidate must possess atleast 5 SCI Publications is not supported by Rules. https://hcservices.ecourts.gov.in/hcservices/
3. Today, when the matter was taken up for hearing, Mr.G. Rajagopalan, learned Additional Solicitor General appearing for the respondents, on instructions, submitted that it is only desirable qualification for the candidates, to have 5 SCI Publications and it does not stall their applications for consideration. In other words, the petitioner's application will be considered / processed for the said post and it is always open to the respondents to fix the higher qualification for the completion of the selection process. The learned Additional Solicitor General also submitted that the petitioner's application submitted in online would also be taken in-to consideration along with others for processing.
4. The submissions so made by the learned Additional Solicitor General appearing for the respondents are recorded.
5. In the light of the submissions, this Court is of the view that no further order is required in this Writ Petition. However, it is left open to the petitioner to approach this Court, if she has any other grievances.
6. With the above observation, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
