This petition has been filed by the petitioner / Accused No.1 to call for the records pertaining to the First Information Report in Crime No.8 of 2025 dated 25.01.2025 on the file of the first respondent police, for the offences under Sections 498A, 406, 506(i) of IPC and Section 3(1) and 4 of Dowry Prohibition Act, 1961 and quash the same.
2. When the matter was taken up for hearing, the learned counsels on both sides represented that the matter has also been amicably settled between the parties and to that effect, they have entered into a compromise and the same was filed before this Court.
3. The defacto-complainant and petitioner before the first respondent police station and appears through Video Conferencing and their identity are also verified by the first respondent police. This Court enquired about the terms of compromise and the defacto-complainant represented that they entered into a compromise and she has no objection to quash the FIR. A compromise memo, dated 06.03.2025 signed by the parties and their respective counsel, is also filed before this Court. Page No. 2 of 4
4. This Court has perused the terms of the compromise memo.
5. Considering the nature of the offences and the close relationship between the parties and they have also entered into a compromise, it is appropriate to allow this petition.
6. Recording the said compromise memo, this criminal original petition is allowed and the First Information Report in Crime No.8 of 2025 dated 25.01.2025 on the file of the first respondent police is quashed as against the petitioner. Consequently, connected miscellaneous petition is closed. The compromise memo dated 06.03.2025 filed by the parties shall form part of this order.
