ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 323, 353 and 506(ii) IPC in Crime No.28 of 2018, seek anticipatory bail.

2.The case of the prosecution is that on 17.04.2018 the defacto complainant, who is working as a Foreman in TNEB at Kamuthi and one Bala Subramaniyam, who is working as a Line Inspector are said to have attacked by the petitioners and restrained by them from doing their official duty.

3.This Court went through the contents of the FIR. It is seen that E.B. Officials without any justification have been assaulted by the petitioners due to sudden provocation, as a result of which, the officials got injured.

4.The learned Government Advocate (Criminal side) pointed out that except the fourth petitioner all are having previous cases to their credit.

5.Considering the nature of allegations made against the petitioners 1 to 3 and 5, this Court dismisses this application for anticipatory bail insofar as the petitioners 1 to 3 and 5 are concerned. Anticipatory bail is granted to the fourth petitioner alone. Accordingly, the fourth petitioner is are ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Ramnad District, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the fourth petitioner shall appear before the respondent police as and when required for interrogation. The fourth petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The fourth petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed.
