Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under Sections 426, 427 and 434 IPC and Section 166 of the Railways Act, 1989 r/w. Section 3(1) of TNPPDL Act, in Crime No.234 of 2018, seek anticipatory bail.

2.The case of the prosecution is that on 09.04.2018 the petitioners and others were conducted demonstration in the Railway Station on Cauvery Water Issue and defacing the letter in the Railway Board.

3.It is submitted by the learned counsel for the petitioners that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution and prays for anticipatory bail in favour of the petitioners. 4.It is submitted by the learned Government Advocate (Criminal side) that the investigation is pending.

5.Taking note of the above said facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.I, Sivagangai, and on https://hcservices.ecourts.gov.in/hcservices/

their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall deposit a sum of Rs.5,000/- to the credit of Crime No.234 of 2018 before the learned Judicial Magistrate No.I, Sivagangai. On such deposit, it is open to the Railway Administration to withdraw the said amount to make good the loss caused by the petitioners herein. The petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed.
