ORDER

It is a petition seeking a direction to the 2nd respondent directing not to harass the petitioner herein in the guise of enquiry.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side).

3. The learned counsel for the petitioner would submit that the petitioner is a tenant and already a civil suit is pending in O.S.No.342/2016 seeking injunction restraining the defendant therein from evicting him except due process of law.

4. The learned Government Advocate (Crl. Side), on instructions, would submit that pursuant to the complaint preferred by one Prema, W/o.Ponnambala Moorthy, against the petitioner herein, the petition enquiry is pending and the petitioner's required for interrogation for one day in respect of the said complaint.

4.1. There is an undertaking by the respondents that they will issue summon to the petitioner, indicating the particular time, place and date and thereafter, the presence of the petitioner is not required.

4.2. There is also an assurance on the part of the petitioner to appear for enquiry for one day on summon on the date to be specified by the respondents.

5. Recording the undertaking given by the respondents, this petition is closed.
