ORDER : The Court Made the following order :- The petitioner is in judicial custody since 11.04.2018 for the offences under Sections 395 and 397 of I.P.C in Crime No.538 of 2000 on the file of the respondent Police. He seeks bail. 2.Absconding Charge Sheet was filed against the petitioner. The learned counsel for the petitioner submits that he was not aware of the implication in the said case.

3.Taking note of all these aspects, this Court is inclined to enlarge the petitioner on bail with certain conditions. Accordingly, the petitioner is ordered to be released on bail, subject to the following conditions;

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court, Nilakottai.

(ii)the petitioner is directed to appear before the Trial Court on all hearing dates.

(iii)on breach of any of the aforesaid conditions, the Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005) AIR SCW 5560].
