Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the interim stay granted in CMP(MD)No.8728/2017 in TR CMP (MD)No.437/2017 on the file of this Honhle Court and thus render justice.
PRAYER IN CMP(MD)No.4041/2018 :
Pleased to permit the petitioner to take a substituted service to respondent in a Tamil news paper having circulation in the Pudukkottai and Trichy District and thus render justice. Prayer in TR CMP(MD).437/2017 :
To withdraw the case in H.M.O.P.No. 75 of 2017 on the file of the District Family Court, Tiruchirappallai and transfer the same to any competent Court at Pudukkottai.
ORDER: These petitions coming on for orders upon perusing the petitions and the affidavits filed in support thereof and upon hearing the arguments of MR.A.ANANDAN, Advocate for the petitioner in both the petitions, the court made the following order:- By the order dated 28.04.2018, the petitioner was directed by this Court to take substituted service to the respondent through paper publication. Even though the said order was passed on 28.04.2018, till date, the petitioner has not taken any steps to publish the substituted service in the newspaper. https://hcservices.ecourts.gov.in/hcservices/ 2.Now, the learned counsel for the petitioner sought for
extension of stay. But, he has not given any proper explanation for non-publication.
3.Considering the submission made by the learned counsel for the petitioner, this Court is of the view that one more opportunity may be given to the petitioner to take steps for publication.
4.Accordingly, the petitioner is permitted to take steps to publish in any of the local Tamil Dailies, having vide circulation in Pudukkottai and Trichy Districts, informing the date of hearing as 26.06.2018.
5.Post the matter on 26.06.2018. Till then, the order of interim stay already granted is extended.
